Following Delhi HC Judgment, Upload all the FIRs in Puducherry Police Website!

Federation for People's Rights (FPR), Secretary, G.Sugumaran issued a Press Release on 15.12.2010:

The Federation for People’s Rights demands the government of Puducherry to observe the recent Delhi High Court Judgment and should upload on Police website all the FIRs filed within twenty-four hours of lodging of the FIR from 1st February 2011 onwards.

In this regard, today (15.12.2010), we sent the following representation to the Chief Secretary, Law Secretary and the Director General of Police enclosing the Judgment copy:

We would like to draw your kind attention on the above referred Judgment pronounced by the Honourable Chief Justice Mr. Dipak Misra and Honourable Justice Mr. Manmohan of Delhi High Court, in W.P. (Crl.) No. 468 of 2010 on 06.12.2010.

The Directions of the Judgment (relevant operating portion) is reproduced here for your kind consideration:

(A) An accused is entitled to get a copy of the First Information Report at an earlier stage than as prescribed under Section 207 of the Cr.P.C.
(B) An accused who has reasons to suspect that he has been roped in a criminal case and his name may be finding place in a First Information Report can submit an application through his representative / agent / parokar for grant of a certified copy before the concerned police officer or to the Superintendent of Police on payment of such fee which is payable for obtaining such a copy from the court. On such application being made, the copy shall be supplied within twenty-four hours.

(D) The copies of the FIR, unless reasons recorded regard being had to the nature of the offence that the same is sensitive in nature, should be uploaded on the Delhi Police website within twenty-four hours of lodging of the FIR so that the accused or any person connected with the same can download the FIR and file appropriate application before the court as per law for redressal of his grievances.

(J) The directions for uploading the FIR on the website of the Delhi Police shall be given effect from 1st February, 2011.

In the light of the above Judgment, we request your authority, to take necessary steps to implement the Court Directions in Puducherry also and circulate the copy of the Judgment to the Offices under your control and all Police Stations, to uphold the rights of the accused, ultimately the HUMAN RIGHTS.

CBI probe sought into Dy Tahsildar recruitment !

The Federation of People’s Rights has sought a CBI probe into the alleged irregularities in the recruitment of deputy tahsildars as well as the purchase of free sarees and dhotis.

In a statement G Sugumaran, secretary of the Federation, stated that resolution to this effect had been adopted by the Federation.

Further he said that there was widespread news that a lot of irregularities had occurred in the recent selection of deputy tahsildars. The government should cancel the selection and initiate a fresh selection process, he said.

The chief secretary of the government stopped the purchase of dhotis and sarees intended for the free distribution scheme for Deepavali, thus preventing high scale corruption. The government should now take steps to distribute the free dhotis and sarees without delay. 

In the notification issued by the police department for the recruitment of sub-inspector and constables, the existing reservation for BC, MBC, BCM, EBC, SC and ST was not followed properly.

The government should intervene in the matter and take steps for proper implementation of the communal reservation.

Dec 10: Human Rights day - Eradicate Corruption and work for good governance!

Federation for People’s Rights, Puducherry, Organising Committee Meeting held at Federation office at Gandhi Road on 08.12.2010 at 6.30 pm. The meeting was presided over by the Federation Secretary G.Sugumaran and Organising Committee Members R.Rajarajan, P.Markandan, C.S.Saminathan, K.Chinnappa, A.Kalaivanan, K.Saravanan, P.Kalidass, K.Kannan, K.Balaji were attended the meeting.

The following resolutions were adopted in the meeting:

1.    In the eve of the World Human Rights day (Dec 10th), we appeal to people to take oath to eradicate and fight against corruption and work for the good governance.

2.    The government’s decision to give Rs. 1000 as rain relief for all poor and rich is a bad precedence. The government should find out the really affected people and provide them the rain relief.

3.    We condemn the cheap politics of the government by printing the portraits of the Union Minister, Chief Minister and Ministers in the application form of the rain relief.  The government should abandon this and offer the rain relief through officials without any delay.

4.    There was a wide spread news that a lot of irregularities occurred in recent selection of Deputy Tahsildar. The government should order for a C.B.I. enquiry in this regard. Also cancel the selection and initiate a fresh selection process.

5.    The Chief Secretary of the government stopped the purchase of Dhotis and Sarees for the free distribution to the people for Deepavali and prevented a multi crore rupees corruption. The government should order for a C.B.I. enquiry in this regard. The government should take steps to distribute the free Dhotis and Sarees without any delay.

6.    In the notification issued by the Police Department for the recruitment of Sub-Inspector and Constables, the existing reservation for BC, MBC, BCM, EBC, SC and ST was not followed properly. The government should intervene in to this matter and take steps for proper implementation of the communal reservation.

7.    The government invoked the National Security Act (NSA) on the cadres of political parties, organizations and the persons who indulge in criminal activities. We urge the government to withdraw the NSA against them, which is contrary to the Human Rights. If needed take action on them in the normal laws like Indian Penal Code.

8.    We demand the government to scrap the Murthikuppam Harbour Project, which will create a huge damage for the livelihood of farmers and fishermen. The already existing Thengaithittu Harbour affected the coast of Puducherry and Tamilnadu. The government should take measures to prevent the sea erosion by adopting the scientific methods without affecting the coastal people.

9.    There is lot of seats vacant in the Arts Colleges of Puducherry due to the delayed counselling conducted by CENTAC. The students applied for these colleges are not allotted seats and so their one year education was affected. The government should take action to allot the vacant seats for the students applied.

10.    The government is not providing the financial aid for the Para Medical students as per the G.O. issued under the Perunthalaivar Kamarajar Financial Assistance Scheme. We press the government to provide the financial assistance for the Para Medical students without delay following the G.O.

Dec 6th: Tribute to Social Revolutionary Dr. B.R.Ambedkar!

Federation for People's Rights (Makkal Urimai Koottamaippu) Secretary G.Sugumaran and Organising Committee Members C.S.Swaminathan, P.Markandan, Kalaivannan, Kalidass paid tributes to Social Revolutionary Dr.B.R.Ambedkar in the eve of his 54th death anniversary. They also garlanded the Ambedkar's statue opposite to the legislative assembly at Puducherry.

Puducherry Students' Federation Founder Sathish (a) Swaminathan paid homage to Ambedkar and students from Tagore Government Arts College and Motilal Nehru Government Polytechnic also participated.

Dec 6 - Take action against the persons responsible for demolition of Babri Masjid!

December 6th: The Puducherry District unit of TMMK organised a Demonstration at 10 am,opposite to Swedesi Mill, demanding to take action against the persons responsible for the demolition of Babri Masjid.

The demo was presided over by TMMK Head Quarters Spokesmen Pudumadam Aneez and Puducherry District Vice-President Habees Mohammad Buhari delivered the welcome address. In the presence of District President M.A.Asraf (a) Rahamattoulla and  District Secretary Y.Pallulla, Manithaneya Makkal Katchi District Secretary I. Mohammad Saleem, Village Panchayat Presidents Co-ordinating Federation Vice-President G.A.Jaganathan, Singaravelar Munnettra Kazhagam President G.C. Chandran, Christian Federation President Samy Arokiasamy delivered the speech.

Federation for People's Rights (Makkal Urimai Koottamaippu) Secretary G.Sugumaran delivered the key note address. TMMK Puducherry District Treasurer J.Kaja Kamal presented the vote of thanks.

The demands raised in the demonstration are:

1. The Supreme Court should deliver its judgment in the appeal petition filed challenging the Allahabad High Court verdict on Babri Masjid land case without any delay.

2. The Government should take steps to speedup the Babri Masjid demolition case pending before the Raebareli Court at U.P.

3. The Central Government should take action against the 68 persons, who were accused for demolition of Babri Masjid in the Justice Liberhan Commission report.

TMMK organizes Seminar on Ayodhya Verdict and Secularism in Chennai!

The Tamilnadu Muslim Munnetra Kazhagam (TMMK) organizes a Seminar on 'Ayodhya Verdict and Secularism' on 25th November 2010 at 6.00 pm at Chennai. The venue of the Seminar is P.T.Thiyagraayar Hall (near Kannadasan Statue) at Thiyagaraaya Nagar (T Nagar).

In the back drop of the recent Babri Masjit - Ayodhya verdict, we, Peoples Union for Human Rights (PUHR), Tamilnadu Chapter President Professor A. Marx and Federation for People’s Rights (FPR), Puducherry Secretary G. Sugumaran visited Ayodhya for an on spot study of the situation and the issue.

After 60 years, on 30th September 2010, the Allahabad High Court delivered the judgment on the title suit of the land on which the demolished Babri Masjit stood. In their judgment the learned judges have ordered to give two thirds of the disputed land for the Hindu litigants and one third to Sunni Wakf Board. This Judgment has created a lot of criticisms from various sections. Now both the parties have decided to appeal to the Supreme Court.

In this background, we, Peoples Union for Human Rights (PUHR), Tamilnadu Chapter President Professor A. Marx and Federation for People’s Rights (FPR), Puducherry Secretary G. Sugumaran visited Ayodhya and other places. We stayed there in Ayodhya from 28th to 31st October, 2010. We met both the Hindu and Muslim Community leaders and litigants and as well as other Left Democratic and Secular Political Leaders and Intellectuals.

We visited Lucknow, Faizabad and Ayodhya and met the Babri Masjid - Ram Janma Bhoomi dispute litigants particularly Allahabad High Court Advocate Mr. Jafaryab Jilani (Sunni Wakf Board), surviving old litigant Mr. Hashim Ansari, one of the leaders of Ram Janma Bhoomi Nayas and former BJP MP Mr. Ram Vilas Vedhanthi, Nirmohi Akhara Mahant Mr. Bhaskara Dass, VHP head quarters Karasevapuram office secretary Mr. Mahendra Upathayaya, the receiver appointed by the Allahabad High Court to supervise the status quo of the disputed site Mr. Kaliq Ahamad, Sarayu Kunj Ram Janagi Mandir Mahant and Ayodhya Pularity Cultural Forum's office bearer Mr. Yugal Kishore Sharan Sasthri, Faizabad Jouranalists Mr. K.K.Pandey (E TV), Mr. Banbir Singh (Ajthak TV), Ms. Suman Guptha, Ram Manohar Lokiya University, History Department Head Mr. Ashok K. Misra (Nominee of the Allahabad High Court to supervise the excavations made by ASI in the disputed site), CPI ML Lucknow State office secretary Mr. Arun Kumar, All India Progressive Women Association, National Vice-President and Tahrqe-a-Niswan's office bearer Ms. Tahari Hasan and youths, general public and recorded their statements.

Also we visited the Ayodhya town, the structures of the Ram temple kept at Karasevapuram, the disputed site of extend 71.3 acres, which was fenced with barbed wire and in the very strong protection of the CRPF police, the temporary temple of Ram Lalla situated in the place where the Babri Masjid was demolished and other related places.

The aim of our visit is to study the mood of the various sections of the people and to suggest an amicable solution which would uphold the Communal Harmony and Peace in India.

We submitted the 8 pages interim report to the nation after the visit in the Chennai Press Club on 2nr November 2010 at 4.00 pm. The English version of the report will be published soon in this blog.

Demand to name Madras HC as High Court of Tamilnadu and Puducherry!

Yesterday (16th Feb) I issued a press statement on behalf of  Federation for People’s Rights (FPR), Puducherry. We urge the Puducherry Government to adopt a resolution in the coming assembly session urging the Union Government to change the proposed name of Madras High Court as High Court of Tamilnadu and Puducherry as is followed while naming the Punjab High Court as of High Court of Punjab and Haryana.

The Central Government recently announced to change the name of Madras High Court as High Court of Chennai and taking steps to enact an act in the ensuing Parliament session. In 1996 the name of Madras city was changed as Chennai. But unfortunately the High Court name remained unchanged and remained as High Court of Madras itself. The Lawyers community at that time demanded to change the name which ended in vain.

We point out that during the pre independence period three Chartered High Courts were formed in Kolkata, Mumbai and Madras. The British Government named these High Courts by the name of the cities itself. It is understandable that the names of these Courts are not changed even after independence. It is surprising that after the names of Bombay, Calcutta and Madras are changed as Mumbai, Kolkata, and Chennai respectively, the High Courts are continued to be called in the same name itself. Under this context, we welcome the move of the Union Government to change the names of High Courts despite of the fact that it should have been done long back.

We heard that there is a demand to change the name as Tamilnadu High Court instead of the proposed name. After naming the state as Tamilnadu the demand is just and logical. It is highly worthy at this juncture to remember the great patriot Sundaralingam who sacrificed his life to get the name ‘Tamilnadu.’

Puducherry as a Union Territory comes under the direct control of High Court of Madras. Puducherry have a unique identity and distinct culture with the profound impact of the French culture. Expressing the ambition of the Puducherry people we request your good office to name the High Court of Madras as High Court of Tamilnadu and Puducherry, as is being adopted in case of naming Punjab High Court as Punjab and Haryana High court, when its jurisdiction has been extends to two states.

To add muscle to our contention we would like to draw the logical precedence of the case of Punjab High court. It is known to one and all that the States Re-organisation Act, 1966, brought another State Haryana by carving out from Punjab which came into existence from November 1st, 1966. From the date of enforcement of the said Act, the High Court of Punjab was renamed as 'the High Court of Punjab and Haryana'.

In this regard,  we have sent a memorandum to the President of India, Prime Minister, Law Minister, Chief Justice of India, Chief Justice of Madras High Court and Tamilnadu Chief Minister to consider our demand. Also we sent letters to all the Political Parties of Puducherry to raise this issue.

I would like to invite you all for the National Seminar on "The Scope and Extent of Civil rights Organisations" on 30th January 2010, Saturday, at IKSA Center at Egmore, Chennai. The seminar will start at 10 am and conclude at 6 pm.

The seminar was organised by People's Union for Human Rights (PUHR) and Federation for People's Rights (FPR) jointly. 

I am presiding the first session. Noted writer and human rights activist Mr. A. Marx, president of PUHR, welcoming the gatherings and delivering the introductory note about the seminar. The senior activist and left oriented writer Mr. S. V. Rajadurai is delivering the key note address.

The main speakers of the seminar are Kavitha Srivatsava, PUCL, Rajasthan, V. S. Krishna, HRF, Hyderabad, Apoorvanand, Delhi University, New Delhi, Satya Sivaraman, Columnist, New Delhi and Nagari Babiah, PDF, Bangaluru.

The second session will be presided by Advocate Rajini, PUHR, Madurai, key note address by Praba. Kalvimani and the main speakers are K. Kesavan, CPCL, Madurai, A.S. Abdul Kader, NCHRO, Madurai, P. Pugazendhi, TPRF, Chennai.

The third session will be an open session. The participants are welcome to express their views and discuss the issues raised in the seminar.
